Terms and conditions
The general terms and conditions of sale and rental that apply to every agreement with Ampli.

1. General terms and conditions of sale and rental
1. The agreement is only concluded when the customer or their authorised representative signs the order form, where applicable after the customer has paid an agreed advance or deposit.
2. Ampli has the right to consider the agreement with the customer dissolved, without owing the customer any compensation, in the following cases:
- bankruptcy, judicial composition or obvious insolvency of the customer
- non-payment or late payment of the amounts owed by the customer
- incorrect information about the identity and/or place of residence of the customer and/or their authorised representative
3. Goods awaiting delivery or collection are stored at the customer's risk.
4. If Ampli is unable to perform the agreement due to force majeure, strikes, lock-outs or similar events, Ampli reserves the right to terminate the agreement without any claim for compensation.
5. The agreement is concluded in Boortmeerbeek. The amounts owed by the customer are payable at Ampli's registered office in Boortmeerbeek.
6. Ampli's invoices are payable immediately, without discount or deduction, no later than the due date stated on the invoice.
7. Every invoice is deemed to be accepted by the customer (or their authorised representative), unless it is disputed by registered letter within eight days of the invoice date. The dispute must state the reasons expressly and unambiguously; otherwise it will not be accepted.
8. All disputes concerning the existence, performance and/or interpretation of the agreement fall under the exclusive jurisdiction of the courts of the judicial district of Leuven. Belgian law applies to these general terms and conditions of sale and rental and to all related agreements between Ampli and the customer.
9. In the event of non-payment, the customer shall automatically, by operation of law and without notice of default, owe Ampli interest on the amounts due of 1% per month or part of a month commenced, as well as fixed compensation of 15% of the amounts due, with a minimum of € 75. If an invoice is not paid on the due date, or if the customer fails to fulfil their obligations in full or in part, all claims against this customer become immediately due, and Ampli may, at its own discretion, suspend the performance of current agreements or consider them void in full or in part.
10. If the agreement is terminated and/or the customer cancels the order, the customer shall owe Ampli compensation of 25% of the purchase price or of the rental price for the full agreed rental period.
11. The agreement is governed by these general terms and conditions, to the exclusion of any differing purchase, sale or rental conditions of the customer.
12. To meet the take-back obligation for professional electrical and electronic equipment, Ampli has joined Recupel and pays an administrative contribution for this. The customer undertakes to bear any costs of collection and processing, both of the professional equipment covered by this order form or invoice when it is discarded, and of the discarded electrical and electronic equipment it replaces. To comply with waste legislation, the customer can use an operator that has a contract with Recupel (www.recupel.be).
2. Specific terms of sale
1. Ampli is not liable for hidden defects of which it was not aware. On pain of losing the warranty, the customer must inform Ampli within eight days of discovering a hidden defect. If the defect can reasonably be repaired, Ampli's warranty obligation is limited to repairing it. If the defect cannot reasonably be repaired, Ampli's warranty obligation is limited to replacing the item with an identical or equivalent item, as far as this is reasonably possible.
2. Ampli's warranty obligation for defects in the goods sold does not extend further than that of its suppliers.
3. Ampli is not bound by any warranty if the defect was caused or partly caused by careless or improper handling by the buyer, use contrary to the intended purpose of the goods, damage by the buyer or third parties, or improper installation of the goods.
4. Defects that existed at delivery and that the buyer or their staff could have found with a normally careful inspection are deemed to be accepted if the buyer has not reported them in writing by registered letter within eight days of delivery or collection. If reported in time, the same warranty applies as for hidden defects.
5. The goods delivered remain the property of Ampli until the full price has been paid. This provision does not prevent the risk of loss and damage from passing to the buyer upon delivery. The seller reserves the right to cancel the sale and take back the goods if the amount owed for the goods has not been paid by the invoice due date.
6. A quotation fee of € 50 is charged for every repair.
3. Specific terms of rental
1. The renter or their authorised representative acknowledges having received the goods in perfect condition and ready for use, and declares to be fully informed of how the rented goods must be used and maintained. Any complaints about the condition of the rented goods must therefore be made upon receipt.
2. The renter undertakes to treat the rented goods with due care, to use them professionally and competently in line with the instructions for use, and to protect them against overload and damage.
3. The rental starts when the rented goods leave Ampli's premises.
4. The rental ends on the day the rented goods arrive back at Ampli's premises in working order, regardless of the agreed end date.
5. If the renter wishes to extend the rental period, they must request this in writing.
This written request must state the period for which the extension is requested.
6. The renter can in no case claim a tacit extension of the rental. The rental period is only extended for the term agreed between Ampli and the customer once the renter has received written confirmation from Ampli.
7. If the rented goods are returned late, the full day rate will be charged in addition for each day or part of a day commenced.
8. If Ampli so chooses, it may require the renter to pay a deposit. This deposit serves to guarantee that the renter fulfils their various obligations.
9. The method of payment of the deposit is agreed in advance and in writing between Ampli and the renter. The deposit cannot be considered an advance on the rental price and can only be refunded to the renter after they have fulfilled all their obligations towards the lessor and have returned the rented goods in good condition.
10. The renter and/or their authorised representative undertakes:
- a) to notify the lessor immediately in the event of a breakdown, theft of the rented goods, bankruptcy, seizure, damage, etc.;
- b) to store the rented goods in a suitable place;
- c) not to repair or modify the rented goods, unless with Ampli's express written consent;
- d) to notify Ampli immediately when repairs are needed as a result of normal wear and tear.
11. During the rental, the renter bears all risks of loss of or damage to the rented goods, whatever the cause. The renter is also responsible, whatever the cause, for all damage caused to any person or property through the use of the rented goods, without exception.
12. If repairs are needed because the rented goods have been damaged, the repair costs are charged to the renter in addition to the rental price.
13. The renter shall take all necessary measures to protect Ampli's ownership rights towards all third parties.
14. Ampli has the right to inspect the rented goods at any time. The customer cannot object to this at any moment.
15. Ampli may terminate the rental agreement immediately, by operation of law and without notice of default, without any right to compensation for the renter, in the following cases:
- a) neglect in the use and maintenance of the rented goods;
- b) overloading of the rented goods;
- c) insufficient protection of the rented goods;
- d) failure by the renter to meet the obligations under these general terms and conditions.
16. The return of the rented goods to Ampli does not automatically mean acceptance and does not exclude a claim for compensation. Ampli has 48 hours after the return of the rented goods, excluding Saturdays, Sundays and public holidays, to inform the renter of its findings regarding damage, loss of value, etc. Ampli will invite the renter in writing to establish the damage jointly, within 48 hours after the rented goods were returned. If the renter does not respond within 48 hours, Ampli has the right to carry out the repairs and/or replace parts at the renter's expense, subject to any rights whatsoever. The rental price remains due until the rented goods have been repaired or replaced.
